Charles E. Gale

Mr. Gale primarily focuses on commercial and real estate litigation. His commercial litigation experience includes representing clients pursuing or faced with claims of breach of contract, breach of fiduciary duty, professional malpractice, tortious interference, fraudulent and negligent misrepresentation, theft of trade secrets, partnership disputes, and claims for securities fraud. Mr. Gale has also represented lenders, landlords, property owners, developers, brokers, and tenants in a wide range of real estate and real estate financing litigation.

Representative cases include:

  • Assisted defense of broker/dealer and prominent Dallas Businessman in dispute before the NASD where broker/dealer's clearing firm was seeking damages of breach of contract of over $800k. Panel found in clients' favor and awarded attorneys' fees expended in defense of broker/dealer's claims.
  • Represented Dallas based trucking company who had purchased 100 defective tractors (18 wheelers) against national manufacturer. Claims including breach of contracts, product liability and fraud. Case settled with terms favorable to client.
  • Assisted defense of Dallas based real estate company in an easement dispute involving commercial property located in Coppell, Texas. Following defense verdict, clients were awarded their attorneys' fee incurred in defending the action.
  • Assisted in prosecution of forcible detainer action requiring hotel tenant to vacate hotel premises.
  • Assisted in prosecution of hotel owner's claims against tenant for holdover rent and late charges. Bench trial resulted in $3.1 m judgment.
